We represent and advise 60% of all banks in Malawi. Our services to banks include but are not limited to dispute settlement [litigation, mediation, conciliation and arbitration], advisory, risk mitigation advice and transactional services.
Our Lusungu Gondwe, and Mwaiwathu Majawa have deep experience in several aspects of banking and corporate finance including syndicated loans, factoring, investment finance, contract farming in agriculture, cross currency swaps, project preparation facilities, project related financing and generally all aspects of cross-border, multi-jurisdiction lending.
Our team has advanced knowledge of the law of capital markets and securities trading. The team has published extensively with reputable thought-leaders on securitization, project finance, and private equity.
Our Corporate law practice is headed by Chifundo Ngwira, a lawyer of over 25 years standing at the Malawi Bar. He has litigated, arbitrated and advised on mergers and acquisitions, company reorganizations and insolvency.
Our lawyers further provide extended legal services such as monitoring compliance of companies with the Companies Act to avoid unnecessary penalties by the Registrar of Companies. The team is available for all manner company secretarial work. It also offers Legal Compliance Audit Services [LCAS] to our Clients. It has also performed legal due diligence assignments in preparation for mergers and acquisitions and several other corporate activities.
For over 20 years state owned enterprise have been extensively privatized either wholly or by having private sector partner with the Government of Malawi. Such divestitures have given birth to serious need for specialized knowledge of the law of Public Private Partnerships [PPP].
Power challenges, shortage of petroleum products in or around 2012 and the discovery of some parcels of minerals in Malawi have spawned quite some legal literature in terms of regulation, export trade, taxation regime, transportation and foreign exchange remittances.
